1. Acceptance of Terms

By accessing or using Maple Mesh Generator (the "Service"), operated by MiddlePath Dev ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms. We do not knowingly collect information from or direct any of our content to anyone under the age of 18.

3. Account Registration and Security

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials and not share them with others
• Notify us immediately of any unauthorized access or security breach
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that provide false or misleading information.

4. License and Usage Rights

Subject to these Terms and your compliance with them, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for both personal and commercial purposes.

Permitted Uses:

• Create digital assets using the Service's tools and features
• Use created assets for personal projects
• Use created assets for commercial projects and client work
• Sell, license, or otherwise monetize assets you create with the Service
• Export and use your assets on third-party platforms including Roblox
• Create a reasonable number of assets (subject to fair use and system availability)

Prohibited Uses:

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any local, state, national, or international law
• Violate or infringe upon any intellectual property rights, including copyrights, trademarks, or patents
• Create, upload, or distribute content that is adult/NSFW in nature
• Create, upload, or distribute content that contains hate speech, promotes violence, or harasses others
• Infringe on the copyrights or intellectual property of others
• Upload malicious code, viruses, or attempt to compromise system security
• Reverse engineer, decompile, or disassemble any aspect of the Service
• Use automated systems or bots to access the Service without permission
• Attempt to gain unauthorized access to other users' accounts or data
• Overburden or interfere with the Service's infrastructure
• Resell, redistribute, or sublicense access to the Service itself (you may sell assets you create, but not the Service)

5. User Content and Intellectual Property

Your Complete Ownership:

You retain full and complete ownership of all digital assets and content you create using the Service ("User Content"). We make no claim to ownership of your User Content. You are free to use, modify, distribute, sell, license, or otherwise exploit your User Content in any way you see fit, without restriction or obligation to us.

Limited Usage Rights for Service Operation:

By creating User Content through the Service, you grant us a limited, non-exclusive, royalty-free license to access, process, and temporarily store your User Content solely for the following purposes:

• Providing, maintaining, and improving the Service
• Technical operations including debugging, monitoring, and optimization
• Ensuring security and preventing abuse
• Complying with legal obligations

This license does NOT grant us any rights to commercially exploit, display publicly, or redistribute your User Content. We will never use your creations for our own benefit, marketing, or any purpose beyond technical operation of the Service.

Data Deletion:

You may request deletion of your account and all associated User Content at any time by contacting us at info@middlepath.dev. Upon receiving your deletion request, we will permanently delete your account and User Content within a reasonable timeframe and will not retain any copies, except as required by law.

Our Content:

All aspects of the Service itself, including but not limited to software, user interface, design, text, graphics, logos, and trademarks, are owned by MiddlePath Dev or our licensors and are protected by copyright, trademark, patent, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our proprietary content without express written permission.

6. Generation Credits and Payments

Credit System:

The Service uses a credit-based system ("Gen Credits") to generate digital assets. Gen Credits must be purchased through Gumroad before use. The number of Gen Credits required for each operation will be clearly displayed in the Service.

Payment Processing:

All payments for Gen Credits are processed exclusively through Gumroad, a third-party payment processor. By purchasing Gen Credits, you agree to Gumroad's terms of service and privacy policy. We do not process, store, or have access to your payment card information.

Refund Policy:

Refund requests will be evaluated on a case-by-case basis. To request a refund, contact us at info@middlepath.dev with your transaction details and reason for the refund request. We will review each request fairly, but refunds are not guaranteed.

No Liability for Third-Party Payment Processing:

We are not responsible for any issues, delays, errors, or disputes arising from Gumroad's payment processing services. All payment-related issues must be resolved directly with Gumroad.

7. Third-Party Services and Integrations

The Service integrates with and facilitates exports to third-party platforms including but not limited to Roblox and Gumroad. Your use of these platforms is governed solely by their respective terms of service and privacy policies.

We are not responsible for:

• The availability, performance, accuracy, or content of third-party services
• Any actions, policies, or decisions made by third-party platforms
• Whether your content complies with third-party platform policies (e.g., Roblox community standards)
• Any damages, losses, or account actions resulting from your use of third-party services
• Changes to third-party APIs, features, or terms that may affect Service functionality

You are solely responsible for ensuring that any content you export to third-party platforms complies with those platforms' terms of service and community guidelines.

8. Service Modifications and Availability

We reserve the right to modify, suspend, or discontinue any feature or aspect of the Service at any time, with or without notice, for any reason. This includes but is not limited to:

• Adding or removing features
• Changing how Gen Credits are consumed
• Modifying integrations with third-party platforms
• Temporarily suspending the Service for maintenance
• Permanently shutting down the Service

We will make reasonable efforts to minimize disruption, but we make no guarantees about Service availability or continuity.

If service changes prevent you from using purchased Gen Credits, refer to Section 6 (Refund Policy) for information about potential refunds.

9. Account Termination

Termination by You:

You may terminate your account at any time by contacting us at info@middlepath.dev and requesting account deletion. Upon termination, your account and all associated User Content will be permanently deleted as described in Section 5.

Termination by Us:

We reserve the right to suspend, restrict, or terminate your account and access to the Service at any time for any legally permissible reason, including but not limited to:

• Violation of these Terms
• Creating prohibited content (NSFW, hate speech, violence, illegal content, copyright infringement)
• Fraudulent activity or payment disputes
• Abusive behavior toward other users or our staff
• Attempting to compromise Service security or infrastructure
• Any other conduct we deem harmful to the Service or community

We will not terminate accounts based on protected characteristics such as race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or age.

Account termination does not entitle you to a refund of unused Gen Credits unless the termination was made in error, as determined by us in our sole discretion.

10. Disclaimers and "As-Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR QUIET ENJOYMENT.

We specifically disclaim any warranties that:

• The Service will be uninterrupted, secure, or error-free
• Generated assets will meet your specific requirements or expectations
• Any defects or bugs will be corrected
• The Service will remain available indefinitely
• Third-party integrations will function properly
• User Content will be preserved or recoverable after deletion or Service issues
• The Service will be compatible with future updates to third-party platforms

Use of the Service is at your own risk. You are solely responsible for any damage to your computer system, loss of data, or other harm resulting from your use of the Service.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MiddlePath Dev AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or business opportunities
• Loss of data or User Content
• Loss of use or service interruption
• Cost of substitute services
• Loss of goodwill or reputation
• Any other intangible losses

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100) OR (B) THE TOTAL AMOUNT YOU PAID TO US FOR GEN CREDITS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not fully apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless MiddlePath Dev, its affiliates, and their respective officers, directors, employees, agents, and representatives from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:

• Your use or misuse of the Service
• Your violation of these Terms
• Your User Content, including any claims of intellectual property infringement
• Your violation of any rights of another person or entity
• Your violation of any applicable laws or regulations
• Your interactions with third-party services including Roblox and Gumroad

We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania and the United States of America, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved in the state or federal courts located in Pennsylvania, and you consent to the exclusive jurisdiction and venue of such courts.

You agree to waive any objection to jurisdiction or venue in such courts. However, we may seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property rights.

14. Changes to Terms

We reserve the right to modify, update, or replace these Terms at any time at our sole discretion. Material changes will be communicated through:

• Email notification to your registered email address
• Prominent notice on the Service
• Updating the "Last Updated" date at the top of this document

Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms. If you do not agree to the new Terms, you must stop using the Service and may request account deletion.

15. General Provisions

Entire Agreement:

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MiddlePath Dev regarding the Service and supersede all prior agreements, understandings, and communications.

Severability:

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Waiver:

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. No waiver shall be deemed a further or continuing waiver of such term or any other term.

Assignment:

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section shall be null and void.

Survival:

Provisions that by their nature should survive termination shall survive, including but not limited to Sections 5 (Intellectual Property), 10 (Disclaimers), 11 (Limitation of Liability), 12 (Indemnification), and 13 (Governing Law).
